Legal authorities
This practice direction replaces the March 31, 2003 practice direction regarding legal authorities.
Citation of Authorities
A participant who relies on a legal authority must, if possible, provide a neutral citation so that other participants can access a copy of the authority without costs, such as through CanLii, or a court or tribunal website.
Applications
Unless the Tribunal directs otherwise, a participant who relies on a legal authority in an application must:
- inform the other participants that they may request a copy of the legal authority from the participant relying on the legal authority, and
- promptly provide another participant or the Tribunal a copy of legal authority on request.
Hearings
A participant who relies on a legal authority in a hearing must provide a copy of the authority to the other participants and the Tribunal, as set out below, unless the parties agree otherwise, or the Tribunal directs otherwise at a case conference or at the hearing.
The Tribunal encourages participants to file a joint book of authorities, if possible.
Supreme Court of Canada Decisions
If a participant at a hearing relies on a Supreme Court of Canada decision listed below, the participant:
- should provide the Tribunal with only a copy of the cover page and the relevant pages from the decision, and
- must provide the other participants with a copy of the full decision, unless the participants agree or the Tribunal directs otherwise.
BC Human Rights Tribunal Decisions
If a participant at a hearing relies on a BC Human Rights Tribunal decision, the participant:
- should provide the Tribunal with only a copy of the cover page and a copy of the relevant pages from the decision, and
- must provide the other participants with a copy of the full decision, unless the participants agree or the Tribunal directs otherwise.
Highlighting copies of legal authorities
The Tribunal encourages participants to highlight the relevant portions of legal authorities provided to the Tribunal and other participants.
